The contract
The contract shall commence once we are in receipt of cleared payment and have acknowledged your booking in writing. Upon making payment (either deposit or in full) you agree to the following terms and conditions herein and enter in the contract.
The lead guest must be at least 18 years of age at the time of booking and a government issued photographic identification should be provided at the time of the initial payment to substansiate as such.
Our Booking Form
All guests should complete the booking form and return it with the correct payment and a copy of the lead guests identification.
Guests making a booking in excess of 6 weeks prior to arrival will be required to pay a 25% reservation deposit. The balance should be paid in full no later than 6 weeks prior to arrival.
Bookings made within 6 weeks prior to arrival will be required to pay the full amount due.
The security deposit must be paid at least 1 week prior to arrival to avoid cancellation of the booking.

If for any reason we decline a booking request any payments made will be immediately refunded.
We reserve the right to refuse a booking without giving any reason.
Failure to pay
Failure to pay the agreed sums on the dates referred to in section 2 may result in the cancellation of your booking and we will be entitled to relet the property without reference to you.

Duration and Times of Lettings
Unless prior arrangements have been agreed with us, you should not arrive before 3pm on the commencement date, and you must leave by 11am on the day of departure. Failure to do so will result in you being charged a further day’s rental. You must use the property solely for personal and/or leisure purposes during the letting period, and not for any other purpose or business use or longer period. The agreement to stay in the property for the letting period, does not create the relationship of Landlord and Tennant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the letting period.
Cancellations
We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
All cancellations must be notified in writing.
Full refund for cancellations up to 30 days before check-in.
If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in.
After that, 50% refund up to 7 days before check-in. No refund after that
Your booking will not be cancelled by us except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday. Our liability for cancellation will be limited to payments made to us.
Changes
Changes to any booking must be requested to us in writing. We will endeavor to be as flexible as possible but any agreement to changes is entirely at our own discretion and will ultimately depend on any other bookings we have at the time of the request that may interfere with any changes.
Use of the Property
The property is for the use of those listed on the booking form which has been pre-approved by us only. Under no circumstances are there to be any extra guests at the apartment without our prior approval.
The property should not be used for any business purposes.
We are in a quiet residential neighbourhood. Parties, gatherings, functions or events are not allowed.
We are in a noise sensitive area and have neighbours in close proximity. If you are in town for a party you may want to consider alternative accommodation.
Any breach to the above rules may result in your stay being terminated early with no refund returned.
Pets
Unfortunately we can not accommodate pets of any kind except for guide dogs and/or disability assistance dogs by prior arrangement with us.
If we agree to allow your dog within the property the following will form part of the booking conditions.
- Only the dog agreed by us will be allowed within the property
- Please keep your dog on a lead around the immediate vicinity of the apartment
- Never leave your dog unattended within the property
- Please ensure your dog is clean and dry before entering the apartment
- Do not allow your dog up on the any furniture including beds or sofas
- Please bring your dogs own bedding and towels. Please do not use the apartment towels to dry your dog.
- Immediately pick up and fouling your dog does in and around the building
- To ensure that dogs behave in such a manner as not to disrupt the enjoyment of other people staying in the vicinity or prejudice the reputation of the owner of the property.
Children
Children are welcome at Harborne Apartment but please be aware of the dangers that may be within the apartment for unaccompanied children. There are many stairs, openable windows, hot water taps, kitchen appliances etc etc. Children should be looked after at all times and we accept no responsibility for any injury ucurred.
- Guests are responsible for the safety and security of their children at all times. Never leave children without adult supervision.
The Gym
Under no circumstances are children under the age of 16 allowed to enter into the gym.
We have professional equipment within the gym and its use is your sole responsibility.
We take no responsibility for any injury, harm or death from the misuse of any of the gym equipment.
Please wipe down equipment after use and return any weights and equipment back to it’s original place.
It is your responsibility to turn off any heating, lights, fans and radio when leaving.
You will have your own key for the gym and it is your responsibility to make sure the gym is locked and secure once you have finished.
Care of the Property
It is your resonsibilty to take care of the property while under your occupation. You must take all reasonable care of the fixtures, fittings and furniture within the apartment.
You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the letting period as at the beginning. You must not use the property for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.
We request noise to be kept to a minimum between the hours of 11pm and 7am.
Damages and the Damage Deposit
Bookings for 30 days or less will require a refundable damage deposit of £500.
Bookings in excess of 30 days will require a refundable damage deposit of £1,000.
Damage deposits must be paid at least 7 days before you arrival at the property. Any payment by cheque for the damage deposit must be received by us at least 3 weeks prior to your arrival at the property.
The deposit is fully refundable within 24 hours of your departure, providing the property has not been left excessively dirty, there have been no breakages, damages, staining to carpets or soft furnishings, excessive use of electricity or lost keys.
In the event that you or anyone staying at the property during your letting period causes damage, loss or incurs a need for professional cleaning services you will be notified in writing of the details of any extra costs incurred after the end of the letting period and this amount shall be deducted from the Damage Deposit. If costs are in excess of the Damage Deposit then an additional payment will be required by you.
General
You agree that the use of any equipment is at your (or any third party residing in the property during the letting period) risk in all respects. You confirm that you are authorised to sign the booking form on behalf of all persons who will occupy the property and that those persons are aware of the booking conditions. You shall be a member of the party occupying the property and are required to ensure that:
1. Each member of the party on whose behalf you have submitted the Booking Form is listed on the Booking Form with his or her full name;
2. Each member of the party is aware of and will comply with all rules and regulations published by ourselves in respect of the use and occupation of the property;
3. The number of persons within the party shall not exceed the maximum number of persons permitted to occupy the property. Any breach of these provisions will constitute a breach of contract, thereupon we may terminate the booking forthwith in which event all monies paid by you will be forfeited and you may be required to vacate the property.
We reserve the right to repossess the property at any time where damage or nuisance have been caused by you or any member of your party and in such event we shall not be liable to make any refund whatsoever.
(a) In the event of any conflict between these booking conditions and any other contents of any brochure or website, these conditions shall prevail.
(b) These terms and the contract between you and us shall be subject to and interpreted in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to hear any claim arising from such contract.
(c) Words herein denoting the masculine gender shall, where the context so admits, be taken to include the feminine and neuter genders and vice versa.
(d) Words herein denoting the singular shall, where the context so admits be taken to include the plural and vice versa.
WE REQUIRE THAT OUR GUESTS READ AND SIGN THE FOLLOWING CONDITIONS WHICH SHOULD BE READ IN CONJUCTION WITH AND FORM PART OF THE BOOKING CONDITIONS.
i. To behave in such a manner as not to disrupt the enjoyment of other people staying in the near vicinity or prejudice the reputation of the owner of the property.
ii. Your letting period or that of any third party residing or making use of the property during the letting period in breach of this clause may be terminated immediately and without Compensation or any further obligation. Any damage to facilities arising out of misuse or as a result of negligence and/or failure to follow the instructions herein will be chargeable to you.
iii. The use of candles inside or outside the apartment is strictly prohibited. Turn off all kitchen appliances before going to bed and close all doors.
House Rules
Pets (if not allowed) vaping or smoking anywhere inside the premises will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to and any damage or extra cleaning caused by pets or smoking will be at the expense of you.
- Please do not move any furniture from one room to another.
- Please remove shoes before going upstairs. Disposable slippers are provided for your use.
- Please lock the doors and close the windows when you leave the property unoccupied.
- Please make sure you switch off lights, heating or any electrical appliances when you go out.
- Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you. Loss of the external door key and the gym key will result in the locks being changed at your expense.
- The client may under no circumstance re-let or sublet the property, even free of charge.
- The owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building, grounds or hot tub/pool.
- No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.
- The owners are not responsible for the loss of any personal belongings or valuables of the guest.
- All inventory must remain in the property and not be taken to another property.
- Candles or naked flames are not allowed inside the apartment.
- We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
We or our representatives reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes.
Use of the Internet
Users of the internet service:
– do so at their own risk, using their own wireless-equipped computing equipment;
– understand that as the Broadband service is provided by Virgin Media, they accept the Virgin Media wifi Terms and Conditions;
– will not hold the owners of Harborne Apartment responsible for any loss or damage, however sustained;
– will not use the service for any unlawful purpose or use the service in any way which may violate or infringe the rights of any individual, firm or company or may be construed as defamatory, offensive, abusive, obscene or which may cause unnecessary anxiety or inconvenience to others;
– will have properly installed, up to date and functioning Firewall and Anti-Virus software;
– will not disclose the security code and/or password to anyone outside the family or party staying at Harborne Apartment.
– understand that any internet service is complimentary & free of charge, if for any reason the service is not available or suffers a breakdown there will be no recompense for that loss of service.
We reserve the right to suspend or cease the wifi service for improper use or for any technical reason without any liability, cost or notice.
The internet we provide is suitable for normal reasonable use. It is not provided for heavy usage
Covid Compliance
- you agree that all members of your party will adhere to the UK Government’s Covid-19 guidelines and regulations, particularly concerning shielding individuals, travel requirements, family groupings, hygiene and social distancing measures. If you are unable to commit to this you will cancel your booking;
2. you agree to arrive at or after the 3pm check in time, to allow sufficient time for the enhanced Covid-19 cleaning protocol to be carried out;
3. clients must immediately notify us if, during their stay, they develop Covid-19 symptoms, test positive for the virus, are contacted by NHS Track & Trace and instructed to self-isolate or are isolating as a result of contact with any person with suspected or confirmed Covid-19; clients must then vacate the property as a group and return to a permanent home address as soon as practicable on the day of notification;
4. in the case of point 3 and you are unable to travel or someone in your party is receiving local hospitalised treatment, then (subject to discussed agreement with us) you may be authorised to remain in the property and an extension given to facilitate self-quarantine if needed. If an extension is required you agree to pay for any additional nights at the advertised rate and to compensate us for any additional costs incurred by us (eg: any cancellation fees incurred as the result of cancelling near future guest bookings);
5. if circumstances arise as at point 3 & 4 you will inform us if a positive Covid-19 test has transpired. If you or any member of your party tests positive for Covid-19 then you agree to pay an additional Covid-19 deep cleaning and decontamination fee of £150 in these circumstances;
6. you agree to adhere to the Guest Departure Checklist which includes enhanced Covid-19 specific actions;
7. within the fourteen (14) days following your departure if you or any of your party experience any suspected symptoms associated with Covid-19 or have contracted confirmed or suspected Covid-19, then you will immediately inform us so that any necessary measures can be taken in relation to staff who may have had contact associated with the property at the time of your stay or immediately following it, including guests who have followed your party;
8. You also agree to provide details of any relevant people whom members of your party may have come into contact with to NHS Track & Trace.
Liability
This condition sets out our entire financial liability (including any liability for the acts or omissions of our employees, agents, consultants and subcontractors) to you in respect of any breach of this agreement; any use made by you or any third party residing or making use of the property during your letting period and any representation, statement or tortious act or omission (including negligence) arising under or in connection with this agreement.
All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this agreement. Nothing in this agreement limits or excludes the liability of us for death or personal injury resulting from negligence or liability incurred by you as a result of fraud or fraudulent misrepresentation by us.
We shall not be liable for loss of profits; loss of business; loss of anticipated savings; loss of personal property or possessions; loss of use of the property or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses in respect of the reservation. Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of the conditions of this agreement shall be limited to the monies paid in respect of your reservation under the conditions of this agreement.
Any personal possessions or vehicle(s) of yours (or any third party making use of the property during the letting period) are left at the property entirely at the risk of the owner of the possessions and the vehicle.
